1. Acceptance of these terms

These Terms of Use govern your use of advancestaffingmemphis.com, operated by Advance Staffing Inc. ("Advance Staffing," "we," "us," or "our"). By using this website or submitting any form on it, you agree to these terms. If you do not agree, please do not use the site.

These terms incorporate our Privacy Policy by reference.

2. What this website is

This website provides information about Advance Staffing Inc. and allows employers to request staffing support, job seekers to submit applications, and visitors to contact us. It is an informational and intake tool. It is not an applicant tracking portal, an employee self-service system, or a payroll system.

3. No offer or guarantee of employment

Submitting an application through this website does not create an employment relationship, an offer of employment, or any promise of placement, hours, assignment duration, or wage rate. No content on this site constitutes an employment contract or a guarantee of continued employment.

Employment in Tennessee is at will. Either party may end the employment relationship at any time, with or without cause and with or without notice, subject to applicable law. No statement on this website modifies that.

4. Eligibility and accurate information

You must be at least 18 years old to apply for the assignments we place, and at least 16 years old to submit any information through this site. You agree that the information you submit is accurate, that it is yours to submit, and that you are authorized to submit it on behalf of any organization you name.

We may decline to process, and may delete, submissions that appear to be fraudulent, automated, abusive, or submitted on another person's behalf without authorization.

5. No fees to job seekers, and fraud warning

Advance Staffing Inc. never charges job seekers a fee of any kind, at any point, for any reason. Not to apply, not to be placed, not for training, not for equipment, not for a background check, and not for transportation.

Recruitment fraud warning. Any communication claiming to be from Advance Staffing Inc. that asks you to pay a fee, purchase equipment or gift cards, cash or deposit a check on our behalf, or provide your Social Security number, driver's license image, or bank account details through a website, text message, or messaging app is fraudulent. We collect identity documents in person, at our Bartlett office, only after you are hired. If you receive such a message, do not respond. Call us at (901) 443-5589 and report it.

6. SMS program terms

Program name: Advance Staffing Assignment and Recruiting Alerts.

Description: Advance Staffing sends text messages about job assignments, shift and schedule information, jobsite locations, screening and onboarding appointments, pay notifications, and, if you separately opt in, hiring event announcements and referral offers.

  • Consent: You opt in by providing your mobile number and checking the contact consent box on our application or event form, by texting us, or by giving verbal consent to a member of our staff. Consent to receive promotional messages is not a condition of employment or of being considered for any assignment.
  • Message frequency may vary.
  • Message and data rates may apply. Charges are between you and your mobile carrier.
  • To opt out: reply STOP to any message. You will receive one confirmation message and no further messages. You may also opt out by calling or emailing us using the details in section 20. We apply an opt-out across all of our messaging programs.
  • For help: reply HELP to any message, or contact us using the details in section 20.
  • Carriers are not liable for delayed or undelivered messages.
  • Supported carriers may change without notice.
  • Privacy: see our Privacy Policy. We do not share SMS opt-in data or consent with any third party for purposes unrelated to delivering these messages.

7. Job postings and assignment details

Positions described on this site reflect roles we staff for client employers. Availability, pay rate, shift, duration, location, and requirements vary by assignment and by client, and are confirmed with you directly before you accept any assignment. Postings may remain visible briefly after a role is filled.

Pay ranges, where shown, are estimates for the type of work described and are not offers.

8. Our role as employer of record

For associates on temporary and temp to hire assignments, Advance Staffing Inc. is the employer of record. We pay wages, withhold and remit payroll taxes, carry unemployment insurance, and maintain Tennessee workers compensation coverage for assigned employees.

Client employers direct day-to-day work at their own premises and control the conditions of their worksites, including site-specific safety training, personal protective equipment, and equipment operation evaluations. We do not control client premises or equipment.

Nothing in these terms is intended to characterize, limit, or determine the legal relationship between Advance Staffing Inc., a client employer, and an assigned employee under any employment, tax, safety, or labor statute. Those determinations are made by the applicable agency or court on the facts. Our safety obligations as a staffing agency are not delegable and we do not attempt to disclaim them.

9. Client services and separate agreements

Submitting a staffing request through this website does not create a binding staffing agreement and does not obligate either party. Staffing services are governed by a separate written services agreement between Advance Staffing Inc. and the client, which controls in the event of any conflict with these terms. Rates, payment terms, conversion terms, replacement guarantees, and insurance requirements are set in that agreement, not here.

We do not accept or honor client requests that specify or imply a preference based on race, color, religion, sex, sexual orientation, gender identity, pregnancy, national origin, age, disability, genetic information, or veteran status, and we do not remove an associate from an assignment on any such basis. Requests of that kind will be declined and the order will not be filled.

11. Acceptable use

You agree not to use this website to submit false information, impersonate another person, transmit malicious code, scrape or harvest data, attempt to gain unauthorized access, interfere with the site's operation, or submit content that is unlawful, harassing, or discriminatory.

12. Intellectual property

The Advance Staffing name, logo, tagline "Moving In The Right Direction," and the text, design, and content of this website are the property of Advance Staffing Inc. and are protected by applicable law. You may not reproduce, distribute, or create derivative works from them without our written permission.

Members of the press may use the materials provided on our media kit page for editorial coverage of Advance Staffing Inc..

13. Third-party links

This site links to third-party websites. We do not control them and are not responsible for their content, practices, or privacy policies. A link is not an endorsement.

14. Accessibility

15. Disclaimers

This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Advance Staffing Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and does not warrant that the site will be uninterrupted, error free, or free of harmful components.

Content on this site, including articles about staffing, hiring, safety standards, and employment practices, is general information. It is not legal, tax, insurance, or compliance advice, and it does not create a professional relationship. Consult your own advisors.

16. Limitation of liability

To the fullest extent permitted by law, Advance Staffing Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of this website, whether based in contract, tort, statute, or otherwise, even if advised of the possibility of such damages.

Nothing in this section limits liability that cannot be limited under applicable law, including liability arising from our obligations as an employer.

17. Indemnification

You agree to indemnify and hold harmless Advance Staffing Inc. from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these terms, your misuse of this website, or your submission of information you were not authorized to submit.

18. Governing law and venue

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or this website will be brought exclusively in the state or federal courts located in Shelby County, Tennessee, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to contact us using the details in section 20 and attempt in good faith to resolve the matter informally for at least thirty days.

Nothing in this section affects any right you have to file a charge with, or participate in an investigation by, the Equal Employment Opportunity Commission, the Tennessee Human Rights Commission, the Department of Labor, the Occupational Safety and Health Administration, the National Labor Relations Board, or any other government agency.

19. Changes to these terms

We may update these terms. The revision date appears at the bottom of this page. Continued use of the site after a change constitutes acceptance of the revised terms.
